In New York State, all NDPAs are negotiated using a standardized structure managed and funded by the 12 NYS Regional Information Centers. To leverage the NDPA with the NYS Exhibit, an entity must qualify as an educational agency under Education Law 2-d.
Educational agencies interested in accessing this centralized structure should contact their local Regional Information Center. These agencies may already be "participating districts" through the use of a Regional Information Center's services, or they may need to join one.
Eligible educational agencies under Education Law 2-d include public school districts, BOCES, 853 schools, Special Acts School Districts, State-supported schools, State-operated schools, and Charter schools. These entities can join a service to leverage the structure. Generally, private schools are not able to leverage the Exhibit G, as they are not required to comply with Education Law 2-d. Entities should consult with their local RIC to determine whether they are an "educational agency".
